Terms & Conditions

These terms apply to every order placed through servmecomputers.co.nz. By placing an order you agree to them. They sit alongside our Shipping, Returns & Refunds and Privacy pages, and nothing here limits the rights you have under New Zealand law.

Who we are

ServMe Computers is the hardware sales division of ServMe IT (NZBN 9 4290 4705 0518), based in Auckland, New Zealand. We are an authorised Ingram Micro reseller. "We", "us" and "our" mean ServMe Computers.

Our products and stock

Most products are supplied to us by Ingram Micro and shipped to you from their New Zealand stock. The stock levels and prices you see are updated regularly, but because they come from our supplier they can change between you adding an item to your cart and us processing your order.

Product descriptions, images and specifications come from manufacturers and our supplier. We take care to show them accurately, but they can contain errors, and manufacturers change specifications without notice.

Prices and GST

  • All prices are in New Zealand dollars (NZD) and include GST unless stated otherwise.
  • Shipping is shown at checkout before you pay. Orders over $750 ship free within New Zealand.
  • Approved trade accounts receive trade pricing while signed in. Trade pricing and promo codes cannot be combined, and a promo code or trade discount will never reduce a price below the minimum we can supply it for.

Pricing errors and unavailable stock

If a product is listed at the wrong price, or turns out to be unavailable from our supplier after you order, we may cancel the order (or the affected items) and give you a full refund. We will contact you promptly when this happens. We will not hold you to a price that is clearly a mistake.

Placing an order and payment

An order is a request to buy. It becomes a contract when we receive your payment and send you an order confirmation email. Payment is taken in full at checkout by card through Stripe. We never see or store your card details.

You must be at least 18 and provide accurate contact and delivery details. If you give us an incorrect address we are not responsible for a failed delivery, and re-delivery may cost extra.

Cancelling an order

You cannot cancel an order yourself on the website. Contact us as soon as possible with your order number. If the order hasn't been dispatched we will cancel it and refund you in full. Once an order has been dispatched, our Returns & Refunds terms apply instead.

Delivery

Delivery times and charges are set out in the Shipping section of our Shipping, Returns & Refunds page. Delivery times are estimates, not guarantees. Risk in the goods passes to you when they are delivered to the address you gave us.

Your consumer rights

If you are buying for personal or household use, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply. Among other things, goods must be of acceptable quality, fit for their usual purpose and match their description. If a product has a fault that is covered by those guarantees, you are entitled to a repair, replacement or refund as the law provides. Nothing in these terms limits those rights.

If you are buying for business purposes, the Consumer Guarantees Act does not apply to the extent the law allows it to be excluded between businesses. The manufacturer's warranty, and any rights you have under the Fair Trading Act, still apply.

Warranty

Products carry the manufacturer's standard warranty. We will help you make a warranty claim, but the manufacturer's warranty is separate from, and in addition to, your rights against us as the seller.

Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential loss (such as lost profit, lost data or downtime) caused by a product or by a delay in delivery. Where the law permits us to limit our liability for a business customer, it is limited to the price you paid for the affected product. This clause does not affect your consumer rights above.

Trade accounts

Trade pricing is available to approved businesses and organisations. We may approve, decline or withdraw a trade account at our discretion. If you receive trade pricing, you confirm you are buying for business purposes.

Your account

You are responsible for keeping your password secure and for activity on your account. Tell us straight away if you think someone else has accessed it.

Changes to these terms

We may update these terms from time to time. The terms in force when you place your order are the ones that apply to that order.

Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
